A couple accused of leaving their dogs to fend for themselves after being evicted from their home were in court this morning.

  Cody and Jessica Manning are facing animal cruelty charges after El Paso County Sheriff’s deputies found a dead Labrador Retriever tied to a tree without food, water, and shelter and a Border Collie in the house in poor condition.

  The couple had been evicted last October and allegedly left the dogs behind.  The dogs were not discovered until December. 

 Cody and Jessica Manning they were arrested on Aggravated Cruelty to Animals, which is a Class 1 Misdemeanor in January.

 If they are found guilty the maximum sentence that they could see would be 18 months in prison and a fine of $5,000.

 The Border Collie has since been adopted.
